rong/inpleteorPartyAmakesmajoralterationstotheapproveddesignandtheinformationgiven,asaresultofwhich,hascausedPartyBtoredothedesignwork,orhasgeneratedunnecessaryabortiveworks,bothpartiesshallenterintonegotiationandtodrawupasupplementarycontract.PartyAshallpensatePartyBfortheadditionalworkloadinaccordancetothenewagreement.6.1.3在合同履行期间，*方单方提出解除合同的，乙方已开始设计工作的，*方应根据乙方已进行的实际工作量支付设计费。6.1.3ShouldPartyAterminatetheContractduringthecontractualperiod,PartyAshallpayPartyBaccordingtotheactualworkdone.6.1.4*方在收到乙方付款通知书后30天内，按本合同第五条规定的金额和时间向乙方支付设计费用；在收到付款通知书的60天仍未支付，每逾期支付一天，应承担应支付金额千分之一的逾期违约金。逾期超过30天以上时，乙方有权暂停履行下阶段工作，并书面通知*方。*方上级对设计文件部审批或本合同项目停缓建，*方均应支付应付的设计费。6.1.4PartyAshallpaythedesignfeetoPartyBwithinThirty(30)daysuponreceivingtheNoticeofPaymentfromPartyAaccordingtotheamountandthetimestipulatedinArticle5.IncasethatsuchpaymentisdelayedforSixty(60)daysuponreceivingtheNoticeofPayment,thenapenaltyof0.1%ofthedueamountofpaymentonadailybasisshallbepaidbyPartyA.Incasethatsuchpaymentisdelayedforaperiodover30days,PartyBshallhavetherighttosuspendtheirdesignworkforthenextphaseandshallinformPartyAinwriting.IncasethatthemanagementofPartyAdoesnotapprovethedesigndocumentsortheconstructionoftheprojectofthisContractisstoppedor..postponed,PartyAshallneverthelesspaytheduedesignfee.6.1.5*方要求乙方比合同规定时间提前提交设计文件时，*方应支付赶工费。6.1.5IfPartyArequestsPartyBtosubmitthedesigndocumentsaheadofthestipulatedtimeasmentionedintheContract,PartyAshallmakeadditionalpaymentforfastandimmediateservice.6.1.6为一方派往现场的工作人员提供工作方便条件。6.1.6PartyAshallprovidesiteofficeandallrelevantofficestationaryforPartyB’spersonnelwhoarebeingsenttoworksiteduringtheconstructionstage.6.1.7*方应保护乙方的设计版权，未经乙方同意，*方对乙方交付的设计文件不得复制或向第三方转让或用于本合同外的项目，如发生以上情况，乙方有权索赔。6.1.7PartyAshallprotectthedesigncopyrightofPartyB.WithoutPartyB’sconsent,PartyAshallnotduplicateoftransfertoathirdpartyorusethedesigndocumentsforotherprojects.Iftheabovementionedishappened,PartyBshallhavetherighttoclaim.6.2乙方责任：6.2ResponsibilitiesofPartyB:6.2.1乙方按本合同第四条规定的内容、时间及份数向*方交付设计文件。6.2.1PartyBshallsubmittoPartyAtherequireddesigndocumentsinrightcontent,timeandcopiesaccordingtotheclauseofArticle4.6.2.2乙方对设计文件出现的遗漏或错误应在施工前负责修改或补充。由于乙方设计错误造成工程质量事故损失，乙方除负责采取补救措施外，应免收损失部分的设计费，并根据损失程度向*方偿付赔偿金，赔偿金额根据乙方与保险公司签订的设计责任保险合同计算。6.2.2PartyBshallberesponsibleforcorrectinganyomissionormistakeintheirdesigndocumentsbeforetheconstruction.IfthedesignmistakemadebyPartyBhascausedlossestoPartyA,PartyBshallnotonlyberesponsiblefortakingtheremedialmeasures,butalsoshallremitthedesignfeeforthepartofsuchlossesandshallpaypensationtoPartyAaccordingtothedegreeofsuchloss.TheamountofthepensationshallbedeterminedbypartyBandhisinsurancepanyandtobeinaccordancetotheprofessionalindemnityinsurancecoverage.6.2.3由于乙方自身原因，延误了按本合同第四条规定的设计文件交付时间，每延误一天，应减收该项目应收设计费的千分之一。6.2.3IfitisPartyB’sownfaulttohavedelayedthesubmissionofthedesigndocumentsaccordingtothestipulatedtimeasdescribedinArticle4,PartyBshalldeduct0.1%ofthedueamountofthedesignfeeonadailybasisforthedelayperiod.6.2.4合同生效后，乙方单方提出解除合同的，乙方应当按照有关规定赔偿*方损失。6.2.4AftertheContractesintoforces,ifPartyBproposestoterminatetheContract,PartyBshallpensatePartyA’slossesaccordingtotherelevantregulations.6.2.5乙方交付设计文件后，应参加*方及相关职能部门的设计审查会议及根据审查结论负责不超出原定计划任务书范围内的必要调整补充；负责向*方及施工各单位进行设计交底，处理有关的设计问题和参加竣工验收。乙方应派相关人员参加施工期间的例会。乙方应优化设计以帮助业主将造价控制在预算内。6.2.5Afterthedesigndocumentshasbeensubmitted,PartyBshallalsoattendtheapprovalmeetingsheldbyPartyAandtherelevantpetentauthoritiesandshallberesponsibleformakingthenecessaryadjustments,revisionsandsupplementswhichdoesnotexceedthescopeofthedocumentsofdesignrequirementsasoriginallydefinedbasedonthementsofsuchmeetings.PartyBshallberesponsibleforexplainingdesigndetailstoPartyAandthemaincontractor;andshallberesponsibleforsolvingalltherelevantdesignproblemsandtoattendthehandingovermeeting.PartyBshallsendtherelevantpersonneltoparticipateintheregularsitemeetingssuringtheconstruction.PartyBshouldoptimizethedesigntoassistPartyAinmeetingtheprojectbudget.6.2.6乙方不得向第三方扩散、泄露、转让*方提交的产品图纸、技术经济资料。如发生以上情况，*方有权向乙方索赔。6.2.6PartyBisnotallowedtodiscloseandtransfertoathirdpartyanyproductdrawing,technicalandeconomicdataetc.whichareprovidedbyPartyA.Incasethattheabovementionedishappened,PartyAshallhavetherighttoclaim.6.2.7未经*方同意乙方不得将本项目的设计工作全部或部分转包给第三者。6.2.7PartyBisnotallowedtosubcontractthedesignworkpletelyorpartiallytoanythirdpartywithoutthepermissionofPartyA.其他约定Article7.Otherprovisions7.1*方要求乙方派专人长期驻施工现场进行配合与解决有关问题时，双方应另行签订技术咨询服务合同。7.1WhenPartyArequiresPartyBtosendsitepersonneltotheconstructionsiteforalongperiod,thetwopartiesshallnegotiatefortheseadditionalworkandsignasupplementaryserviceContract.7.2乙方为本合同项目所采用的国家或地方标准图，由*方自费向有关出版部门购买。7.2PartyAshallpayforalltherelevantpublicationsandstandardcollectionsofdrawingsissuedbythestateandlocalgovernmentwhichareneededbyPartyBforthepurposeofdesigningtheproject.7.3本合同第四条规定乙方交付的设计文件份数超过本合同第四条规定的份数，乙方另收工本费。7.3IfPartyBisrequestedtosubmitdesigndocuments,ofwhich,thenumberofcopiesaremorethanthosestipulatedinArticle4ofthisContract,PartyAshallpayforthoseadditionalcopies.7.4本工程项目中，建筑材料、设备的加工订货，*方需
